Please read these Terms of Service ("Terms") carefully before using the Inkica platform operated by Inkica ("we", "us", or "our").

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our service.

1. Description of Service

Inkica is a print-on-demand order management platform (ERP) that allows sellers to:

  • Connect their marketplace accounts (eBay, Etsy, TikTok Shop, Shopify, Amazon, Walmart, SHEIN)
  • Sync and manage orders from multiple marketplaces in one place
  • Route orders to print-on-demand fulfillment factories
  • Track production and shipping status

2. Account Registration

To use Inkica, you must:

  • Create an account with a valid email address
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account.

3. Marketplace Integrations

By connecting a marketplace account (eBay, Etsy, TikTok Shop, Shopify, Amazon, Walmart, SHEIN), you:

  • Authorize Inkica to access your marketplace orders and shop data
  • Confirm that you have the right to connect that marketplace account
  • Understand that Inkica will sync order data including buyer information

Inkica will only read order data necessary to provide the service and will not modify your marketplace listings or communicate with buyers on your behalf.

4. Acceptable Use

You agree not to use Inkica to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit spam or unauthorized communications
  • Attempt to gain unauthorized access to our systems
  • Use the service for any fraudulent purpose
  • Violate the terms of service of any connected marketplace

5. Payment and Billing

  • Inkica uses a wallet-based system for fulfillment costs
  • Sellers fund their wallet via bank transfer
  • Fulfillment costs are deducted from the wallet when orders are pushed to factories
  • Refunds are processed back to the wallet in case of fulfillment failures
  • All amounts are in USD unless otherwise stated

6. Intellectual Property

The Inkica platform, including its design, features, and content, is owned by Inkica and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. Data and Privacy

Your use of Inkica is also governed by our Privacy Policy available at https://inkica.com/privacy-policy. By using our service, you consent to the data practices described in the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, Inkica shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of profits or revenue
  • Loss of data
  • Delays or failures in order fulfillment caused by third-party factories or marketplaces
  • Marketplace account suspension or restrictions

Our total liability to you for any claim arising from your use of Inkica shall not exceed the amount you paid to us in the 3 months preceding the claim.

9. Disclaimer of Warranties

Inkica is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may terminate your account at any time by contacting us at api.dev@inkica.com.

Upon termination:

  • Your access to the platform will be revoked
  • OAuth tokens for connected marketplaces will be deleted
  • Order history may be retained for legal compliance purposes

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of the service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
